Antes de aceitar o Contrato, você deve ler cuidadosamente todo o conteúdo do Contrato e conhecer totalmente seus termos, especialmente as cláusulas restritivas ou exceções. As cláusulas restritivas ou exceções estão em negrito ou destacadas em outras formas para chamar sua atenção. Em caso de dúvida sobre os termos do Acordo, entre em contato com o departamento comercial da Eastern Kestone Eletrônico e Segurança LTDA. O Contrato de Serviço (doravante denominado “o Contrato”) é assinado por você e pela Eastern Kestone Eletrônico e Segurança LTDA. Inclui (mas não se limita a) Política de Privacidade da Eastern Kestone Eletrônico e Segurança LTDA e outros conteúdos. Em caso de alteração, a Eastern Kestone Eletrônico e Segurança LTDA anunciará por meio do software licenciado enviando mensagem sem prévio aviso. Após o anúncio, o acordo alterado e as regras tornam-se parte do Acordo automaticamente, sem notificação adicional para seu consentimento. Em caso de objeção a tais alterações relevantes, interrompa o uso do serviço da Eastern Kestone Eletrônico e Segurança LTDA; se continuar a usá-lo, será considerado que você não tem objeções às regras alteradas e concorda em cumpri-las.
I. Definições de termos
1.1 Software licenciado refere-se ao sistema de software desenvolvido pela Eastern Kestone Eletrônico e Segurança LTDA, baixado, instalado e aplicado em terminais móveis do sistema especificado.
1.2 Serviços referem-se aos serviços prestados a você pela Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores. Você pode usar esses serviços no terminal móvel com o software licenciado.
II. Serviço
2.1 A Eastern Kestone Eletrônico e Segurança LTDA oferece serviços de gerenciamento de equipamentos de vida inteligente, com base nos quais você pode acessar os terminais inteligentes da Eastern Kestone Eletrônico e Segurança LTDA e a plataforma inteligente de seus fornecedores através do Eastern Kestone Eletrônico e Segurança LTDA Control e realizar a interligação entre equipamentos inteligentes. O conteúdo do serviço inclui gerenciamento de equipamento inteligente, interligação de cena e relatório de análise, etc. Essas funções podem ser otimizadas ou modificadas de acordo com as mudanças das demandas dos usuários ou julgamento do fornecedor do serviço, e o fornecimento do serviço pode ser suspenso devido à manutenção regular e irregular.
III. Escopo do serviço
3.1 A Eastern Kestone Eletrônico e Segurança LTDA concede a você o direito de uso do produto baseado neste software.
3.2 Você está proibido de licenciar, vender, arrendar, transferir, emitir o produto em qualquer forma ou usar o produto para outros fins comerciais. 3.2 Vencido às limitações na plataforma de adaptação de software e terminais, você só pode usar o software licenciado na plataforma de sistema e terminal autorizados; se você instalar o software licenciado em outro equipamento terminal, pode danificar o hardware ou a função do software.
3.3 Você reconhece que o software licenciado só pode ser usado para fins não comerciais e a instalação, aplicação e execução do software licenciado são proibidas. Caso tal operação comercial seja necessária, deverá ser obtida autorização prévia por escrito e permissão da Eastern Kestone Eletrônico e Segurança LTDA.
3.4 Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores podem alterar, atualizar ou transferir o software licenciado ou funções relevantes de tempos em tempos, e podem adicionar novas funções ou serviços no sistema de software licenciado. Se nenhum contrato separado for acompanhado das novas funções ou serviços mencionados, você terá direito às funções e serviços correspondentes, que também estão sujeitos ao Contrato.
3.5 Você será responsável pela precisão, confiabilidade, integridade e legalidade dos dados de entrada e pela legalidade da maneira como você obtém os dados, e deve fazer backup dos dados e informações de tempos em tempos. Você deve assumir todos os riscos por danos e perda de tais informações.
3.6 Você deve manter seu número de conta e senha de maneira adequada. IV. Uma terceira festa
4.1 Você reconhece que certos serviços da Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores são baseados em software ou serviços fornecidos por terceiros. Esse serviço é definido para facilitar a sua aplicação e a autorização legal necessária é obtida de terceiros.
4.2 O produto inclui certas informações e serviços de terceiros. A Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores não controla nem se responsabiliza pelas informações e serviços de terceiros.
4.3 Você reconhece que a Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores não podem garantir que o software licenciado sempre use ou contenha tais serviços, ou que outro software fornecido pelo mesmo terceiro será usado no futuro. Da mesma forma, pode usar serviços semelhantes fornecidos por terceiros. Mediante solicitação, o software ou serviços correspondentes mencionados acima estão sujeitos a este Contrato.
V. Padrão de Aplicação de Serviço
5.1 Você deve usar o software licenciado de maneira normal. As seguintes formas violam o padrão do aplicativo:
1) Emitir ou compartilhar vírus de computador, worms, códigos maliciosos ou software que danifique ou altere deliberadamente o sistema do computador ou dados;
2) Coletar informações ou dados de outros usuários sem autorização, por exemplo, endereço de e-mail e similares;
3) Usar o produto de forma maliciosa de forma automática, causando sobrecarga no servidor, ou interferir ou danificar servidor web e links de rede de outras formas.
4) Tentar visitar dados do servidor ou dados de comunicação do produto sem autorização;
5) Interferir ou danificar o aplicativo de produção de outros usuários.
5.2 Você entende e concorda que:
1) A Eastern Kestone Eletrônico e Segurança LTDA determinará se você está ou não envolvido em violação dos padrões acima e suspenderá ou
encerrar a licença do aplicativo de acordo com os resultados da determinação ou aceitar outras restrições de acordo com os acordos.
2) A Eastern Kestone Eletrônico e Segurança LTDA excluirá informações diretamente em violação das leis, ou infringindo os direitos legais de terceiros, ou em violação do Contrato emitido por você ao usar o software licenciado.
3) Se um terceiro sofrer danos devido à violação dos padrões de aplicação, você deverá assumir a responsabilidade legal de forma independente em seu nome, e proteja e indenize a Eastern Kestone Eletrônico e Segurança LTDA de perdas ou despesas adicionais geradas com elas. Caso contrário, a Eastern Kestone Eletrônico e Segurança LTDA tem o direito de reclamar uma indenização.
4) Se a Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores sofrerem com qualquer perda devido à violação das leis pertinentes ou do Contrato, você deverá indenizar a Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores por perdas e (ou) despesas geradas a partir delas.
VI. Padrão de conteúdo de informação
6.1 Você promete que não irá realizar nenhum ato que viole as leis ou comportamentos impróprios ao usar o serviço, tal ato e comportamento incluem (mas não se limitam a):
6.1.1 Carregar, transferir ou compartilhar informações contendo um dos seguintes conteúdos:
1) Opondo-se aos princípios básicos determinados na Constituição;
2) Colocar em perigo a segurança do estado, revelando segredos de estado, subvertendo o poder do estado e sabotando a unidade do estado;
3) Prejudicial honra e benefício do estado;
4) Incitar o ódio nacional e a discriminação e sabotar a unidade nacional;
5) Destruir a política religiosa do estado e defender a heresia e superstição feudal;
6) Espalhar boatos, perturbando a ordem social e destruindo a estabilidade social;
7) Espalhar obscenidade, pornografia, jogos de azar, violência, assassinato e terror ou encorajar um crime;
8) Insultar ou caluniar os outros e infringir os direitos e interesses legais de terceiros;
9) Contendo conteúdo de farsa, fraude, dano, ameaça, violação da privacidade de terceiros, assédio, violação, calúnia, grosseria, indecência ou conteúdo moralmente repulsivo;
10) Contendo outros conteúdos restritos ou proibidos pelas leis, regulamentos, regras, disposições e outras normas legais aplicáveis.
VII. Política privada e dados
7.1 É fundamental para a Eastern Kestone Eletrônico e Segurança LTDA proteger suas informações pessoais. Eastern Kestone Eletrônico e Segurança LTDA prepares Eastern Kestone Eletrônico e Segurança LTDA Política de Privacidade, na qual são divulgados conteúdos relativos à titularidade e proteção da propriedade intelectual, coleta, uso, compartilhamento, armazenamento e proteção, etc. de suas informações. VIII. Cláusulas de exceção
8.1 A menos que especificado de outra forma nas leis e regulamentos, a Eastern Kestone Eletrônico e Segurança LTDA fará o possível para garantir a segurança, validade, precisão e confiabilidade do software licenciado e das tecnologias e informações envolvidas, mas a Eastern Kestone Eletrônico e Segurança LTDA não pode garantir o mesmo devido à restrição das tecnologias disponíveis atualmente.
8.2 Você entende que a Eastern Kestone Eletrônico e Segurança LTDA não se responsabilizará por perdas diretas ou indiretas causadas por força maior e inadimplência de terceiros.
8.3 Você será responsável por lesões pessoais ou incidentais ou indiretamente causadas por ou relacionadas a um dos seguintes acidentes:
1) Um terceiro usa o software licenciado ou altera seus dados sem permissão;
2) Despesas e perdas geradas pela utilização do software licenciado;
3) Seu mal-entendido sobre o software licenciado;
4) Outras perdas relacionadas ao software licenciado causadas por motivos não atribuíveis à Eastern Kestone Eletrônico e Segurança LTDA.
8.4 Qualquer outro software derivado de software licenciado não desenvolvido e lançado pela Eastern Kestone Eletrônico e Segurança LTDA ou o desenvolvimento e liberação não são concedidos pela Eastern Kestone Eletrônico e Segurança LTDA é software ilegal. Baixar, instalar e usar esse software pode causar riscos imprevisíveis. A Eastern Kestone Eletrônico e Segurança LTDA estará livre de responsabilidades legais e disputas nela geradas e a Eastern Kestone Eletrônico e Segurança LTDA terá o direito de suspender ou rescindir a licença do aplicativo e / ou outros serviços.
8.5 Você foi informado de que a utilização da Eastern Kestone Eletrônico e Segurança LTDA e da plataforma inteligente de seu fornecedor envolve serviço de Internet, que pode ser afetado por fatores de instabilidade em todos os links. Embora a Eastern Kestone Eletrônico e Segurança LTDA tenha tomado medidas de proteção, o serviço pode ser suspenso, encerrado, atrasado, sofrido por restrição de aplicativo ou falha do aplicativo devido a defeitos inerentes à Internet e comunicação eletrônica, bem como fatores além do controle razoável de qualquer parte o Acordo (incluindo, mas não se limitando a incêndio, inundação, ataque terrorista, pestilência, desastres naturais, motim, vírus terminal, ataque de hacker, falha de rede e falha terminal). IX. Rescisão do Contrato e Quebra do Contrato
9.1 Você deve entender que deve usar o software licenciado de acordo com o escopo da autorização, respeitar a propriedade intelectual do software e do conteúdo contido no software e cumprir as obrigações de acordo com o Contrato ao usar os serviços da Eastern Kestone Eletrônico e Segurança LTDA. A Eastern Kestone Eletrônico e Segurança LTDA rescindirá a licença do aplicativo se você violar materialmente o Contrato.
9.2 Sua aplicação do software conta com serviços de suporte fornecidos pelas empresas relacionadas da Eastern Kestone Eletrônico e Segurança LTDA. A violação de termos, acordos, regras, anulação e outros regulamentos relevantes da Eastern Kestone Eletrônico e Segurança LTDA e suas empresas relacionadas podem causar falha no uso normal do software licenciado, neste caso, a Eastern Kestone Eletrônico e Segurança LTDA terá o direito de rescindir o licença do aplicativo ou tomar medidas para restringir a licença do aplicativo ou outros direitos e interesses controlados pela Eastern Kestone Eletrônico e Segurança LTDA conforme acordado no Contrato, incluindo suspensão ou rescisão da licença do aplicativo.
9.3 Em caso de violação do Contrato ou de outros acordos firmados com a Eastern Kestone Eletrônico e Segurança LTDA, a Eastern Kestone Eletrônico e Segurança LTDA e seus fornecedores terão o direito de notificar as empresas relacionadas, obrigando-as a tomar medidas restritivas aos seus direitos e interesses, incluindo exigir que empresas relacionadas suspendam ou encerrem o fornecimento de parte ou da totalidade dos serviços para você, e anunciem legalmente sua violação de acordo em sites administrados ou efetivamente controlados por eles.
9.4 O software licenciado é baixado da plataforma de download e você deve obedecer às estipulações da plataforma de download, plataforma do sistema e fabricação do terminal sobre as formas de aplicação e restrições do software licenciado. Se o terceiro mencionado acima confirmar que você está violando o acordo e a Eastern Kestone Eletrônico e Segurança LTDA e o tratamento de seu fornecedor for necessário, a Eastern Kestone Eletrônico e Segurança LTDA pode rescindir a licença do seu aplicativo a pedido do terceiro.
9.5 Quando a licença do aplicativo terminar, você deverá parar de usar o software licenciado e destruir todas as cópias.
9.6 Você deve arcar com todas as responsabilidades de compensação se a Eastern Kestone Eletrônico e Segurança LTDA e outros usuários sofrerem perdas causadas por sua violação dos termos do Contrato.
X. Leis Aplicáveis e Divisibilidade
10.1 A eficácia, explicação, alteração, execução e solução de controvérsias do Contrato estão sujeitas às leis da República Popular da China. Se não houver leis e regulamentos relevantes disponíveis, deve-se fazer referência às práticas comerciais internacionais gerais e (ou) às práticas industriais.
10.2 Disputas decorrentes de ou em conexão com o Contrato podem ser resolvidas por você e a Eastern Kestone Eletrônico e Segurança LTDA por meio de negociação amigável ou submetidas ao Tribunal Popular de Informe o endereço da empresa onde o Contrato foi assinado para julgamento.
10.3 Quando qualquer termo do Contrato for considerado inválido pelo Tribunal do Povo, isso não afetará a eficácia de outros termos ou de qualquer parte deles, e você e a Eastern Kestone Eletrônico e Segurança LTDA deverão cumprir os termos válidos de boa fé.

Service Agreement of Eastern Kestone Eletrônico e Segurança LTDA

Welcome to Use EKAZA of Eastern Kestone Eletrônico e Segurança LTDA
Before accepting the Agreement, you are supposed to thoroughly read all contents of the Agreement, and fully know its terms, especially restrictive clauses or exceptions. Restrictive clauses or exceptions are bold or highlighted in other forms to catch your attention. In case of any doubt for the terms of the Agreement, please contact relevant business department of Eastern Kestone Eletrônico e Segurança LTDA. You are not allowed to use the service before you have read and accepted all terms of the Agreement, relevant agreements and rules, etc. Once you select “agree and submit the Agreement” (see registration page for detailed wordings) and complete the registration procedure, or you use the service in any form, it will be deemed that you have read and agreed with the restriction of the Agreement and rules above. In case of any breach of the Agreement, Eastern Kestone Eletrônico e Segurança LTDA has the right to unilaterally restrict, suspend or terminate the service for you, and has the right to investigate your relevant responsibilities.
The Service Agreement (hereinafter referred to as “the Agreement”) is signed by you and Eastern Kestone Eletrônico e Segurança LTDA. It includes (but not limited to) Eastern Kestone Eletrônico e Segurança LTDA Privacy Policy and other contents. In case of change, Eastern Kestone Eletrônico e Segurança LTDA will announce by means of the licensed software sending a message without further notification. Upon announcement, the changed agreement and rules become a part to the Agreement automatically, without further notification to you for your consent. In case of objection to such relevant changes, stop use Eastern Kestone Eletrônico e Segurança LTDA’s service; if you keep using it, it will deemed as that you hold no objections against the changed rules and agree to abide by them.
I. Definitions of Terms
1.1 Licensed software refers to software system developed by Eastern Kestone Eletrônico e Segurança LTDA, downloaded and installed and applied in
specified system mobile terminals.
1.2 Services refer to services provided for you by Eastern Kestone Eletrônico e Segurança LTDA and its suppliers. You can use such services on the
mobile terminal with the licensed software.
II. Service
2.1 Eastern Kestone Eletrônico e Segurança LTDA offers you intelligent life equipment management services, based on which you can access
the intelligent terminals on Eastern Kestone Eletrônico e Segurança LTDA and its suppliers’ smart platform through the Eastern Kestone Eletrônico e
Segurança LTDA Control, and realize interlinkage among intelligent equipment. Service contents include intelligent equipment management, scene interlinkage and analysis report, etc. Such functions may be optimized or modified according to changes of users’ demands or judgment of service supplier, and service supply may be suspended due to regular and irregular maintenance.
III. Scope of Service
3.1 Eastern Kestone Eletrônico e Segurança LTDA grants you with the right to use the product based on this software.
3.2 You are prohibited to license, sell, lease, transfer, issue the product in any form, or use the product for other commercial purpose. 3.2 Due
to limitations on software adaptation platform and terminals, you can only use the licensed software in the authorized system platform and terminal; if you
install the licensed software on other terminal equipment, it may damage your hardware or software function.
3.3 You acknowledge that the licensed software can only be used for non-commercial purpose and installation, application and running of the
licensed software is prohibited. If such commercial operation is necessary, prior written authorization and permission from Eastern Kestone Eletrônico e
Segurança LTDA shall be obtained.
3.4 Eastern Kestone Eletrônico e Segurança LTDA and its suppliers may change, upgrade or transfer the licensed software or relevant functions
from time to time, and may add new functions or services in the licensed software system. If no separate agreements are accompanied with the aforesaid
new functions or services, you are entitled to the corresponding functions and services, which is also subject to the Agreement.
3.5 You shall be responsible for the accuracy, reliability, integrity and legality of input data and legality of the way in which you obtain the data, and shall back up data and information from time to time. You shall bear all risks for damage and loss of such information.
3.6 You shall properly keep your account number and password. In case of any safety loophole for your account (including but not limited to
divulgence of user password), you shall notify Eastern Kestone Eletrônico e Segurança LTDA in time, and Eastern Kestone Eletrônico e Segurança LTDA will
assist you in taking relevant measures. Otherwise, all behaviors related to your account shall be assumed by you and you will bear all responsibilities.
IV. A Third Party
4.1 You acknowledge that certain service of Eastern Kestone Eletrônico e Segurança LTDA and its suppliers is based on software or services
provided by a third party. Such service is set to facilitate your application and necessary legal authorization is obtained from the third party.
4.2 The product includes certain information and services of the third party. Eastern Kestone Eletrônico e Segurança LTDA and its suppliers
neither controls nor bears responsibility for information and services of the third party.
4.3 You acknowledge that Eastern Kestone Eletrônico e Segurança LTDA and its suppliers cannot guarantee that the licensed software always uses or
contains such services, or that other software provided by the same third party will be used in future. Likewise, it may use similar services supplied by
another third party. Upon application, the aforesaid corresponding software or services are subject to this Agreement.
V. Service Application Standard
5.1 You shall use the licensed software in a normal manner. The following ways are in breach of the application standard:
1) Issue or share computer virus, worms, malicious codes, or software that deliberately damages or changes computer system or data;
2) Collect information or data of other users without authorization, for example, email address and the like;
3) Maliciously use the product in an automatic way, causing over load to the server, or interfere with or damage web server and network links in
other forms.
4) Attempt to visit server data or communication data of the product without authorization;
5) Interfere with or damage the production application by other users.
5.2 You understand and agree that:
1) Eastern Kestone Eletrônico e Segurança LTDA will determine whether or not you are involved in violation of standards above, and suspend or
terminate your application license according to determination results or take other restrictions according to agreements.
2) Eastern Kestone Eletrônico e Segurança LTDA will directly delete information in breach of laws, or infringing others’ legal rights, or in breach
of the Agreement issued by you when using the licensed software.
3) If a third party suffers from damage due to your breach of application standards, you shall independently bear legal responsibility in
your name, and protect and indemnify Eastern Kestone Eletrônico e Segurança LTDA from losses or additional expenses generated therefrom. Otherwise, Eastern Kestone Eletrônico e Segurança LTDA has the right to claim compensation.
4) If Eastern Kestone Eletrônico e Segurança LTDA and its suppliers suffers from any loss due to your breach of relevant laws or the Agreement, you
shall compensate Eastern Kestone Eletrônico e Segurança LTDA and its suppliers for losses and (or) expenses generated therefrom.
VI. Information Content Standard
6.1 You promise that you will not conduct any act in breach of laws or improper behaviors by using the service, such act and behavior include (but
not limited to):
6.1.1 Uploading, transferring or sharing information containing one of the following contents:
1) Opposing the basic principles determined in the Constitution;
2) Endangering state safety, disclosing state secret, subverting state power and sabotaging state unity;
3) Damaging state honor and benefit;
4) Inciting national hatred and discrimination and sabotaging national unity;
5) Destroying religious policy of the state and advocating heresy
and feudalistic superstition;
6) Spreading rumors, disturbing social order and destroying social stability;
7) Spreading obscenity, porn, gambling, violence , murder and terror or abetting a crime;
8) Insulting or slandering others and infringing on the legal rights and interests of others;
9) Containing contents of sham, defraudation, harm, threat, infringement to others’ privacy, harassment, infringement, slander, coarseness,
indecency, or morally repulsive contents;
10) Containing other contents restricted or forbidden by applicable laws, regulations, rules, provisions and other legal standards.
VII. Private Policy and Data
7.1 It is crucial for Eastern Kestone Eletrônico e Segurança LTDA to protect your personal information. Eastern Kestone Eletrônico e Segurança LTDA
prepares Eastern Kestone Eletrônico e Segurança LTDA Privacy Policy, in which contents related to ownership and protection of intellectual property,
collection, use, share, storage and protection, etc. of your information are disclosed. You are suggested to thoroughly read Eastern Kestone Eletrônico e
Segurança LTDA Privacy Policy.
VIII. Exception Clauses
8.1 Unless otherwise specified in laws and regulations, Eastern Kestone Eletrônico e Segurança LTDA will do its best to ensure the security,
validity, accuracy and reliability of the licensed software and technologies and information involved, but Eastern Kestone Eletrônico e Segurança LTDA is unable to guarantee the same due to restriction by available technologies nowadays.
8.2 You understand that Eastern Kestone Eletrônico e Segurança LTDA will not assume responsibility for direct or indirect losses caused by force majeure and default of a third party.
8.3 You shall be responsible for personnel injury or incidental or indirectly injury caused by or related to one of the following accidents:
1) A third party uses the licensed software or changes your data without permission;
2) Expenses and losses produced by using thelicensed software;
3) Your misunderstanding of the licensed software;
4) Other losses related to licensed software caused by reasons not attributable to Eastern Kestone Eletrônico e Segurança LTDA.
8.4 Any other licensed software-derived software not developed and released by Eastern Kestone Eletrônico e Segurança LTDA or the development and release are not granted by Eastern Kestone Eletrônico e Segurança LTDA is illegal software. Downloading, installing and
using such software may cause unpredictable risks. Eastern Kestone Eletrônico e Segurança LTDA shall be free from legal responsibilities and disputes generated therein and Eastern Kestone Eletrônico e Segurança LTDA shall have the right to suspend or terminate application license and/or other all services.
8.5 You have been informed of that the usage of Eastern Kestone Eletrônico e Segurança LTDA and its supplier’s smart
platform involves in Internet service, which may be affected by unstable factors in all links. Although Eastern Kestone Eletrônico e Segurança LTDA has taken safeguard measures, the service may be suspended, terminated, delayed, suffered from application restriction or application failure due to inherent defects of Internet and e-communication as well as factors beyond reasonable control of any party to the Agreement (including but not limited to fire, flood, terrorist attack, pestilence, natural disasters, riot, terminal virus, hacker attack, network fault and terminal fault). You hereby agree to bear foregoing risks and agree that Eastern Kestone Eletrônico e Segurança LTDA is free from
any responsibility when normal running of services are influenced by the occurrence of foregoing risks.
IX. Agreement Termination and Breach of Agreement
9.1 You should understand that you shall use the licensed software according to authorization scope, respect intellectual property of software and contents contained in the software, and perform obligations according to the Agreement when using Eastern Kestone Eletrônico e Segurança LTDA’s services. Eastern Kestone Eletrônico e Segurança LTDA will terminate the application license if you are in material breach of the Agreement.
9.2 Your application of the software relies on supporting services supplied by Eastern Kestone Eletrônico e Segurança LTDA’s related companies. Breach of terms, agreements, rules, annunciation and other relevant regulations of Eastern Kestone Eletrônico e Segurança LTDA and its related companies may cause failure in normal usage of licensed software, in which case, Eastern Kestone Eletrônico e Segurança LTDA shall be entitled to terminate the application license, or take measures to restrain your application license or other rights and interests controlled by Eastern Kestone Eletrônico e Segurança LTDA as agreed in the Agreement, including suspension or termination of your application license.
9.3 In case of your breach of the Agreement or other agreements signed with Eastern Kestone Eletrônico e Segurança LTDA, Eastern Kestone Eletrônico e Segurança LTDA and its suppliers shall have the right to notify the related companies, requiring them to take restrictive measures to your rights and interests, including requiring related companies to suspend or terminate supplying part or whole services for you, and legally announce your breach of agreement on websites run or actually controlled by them.
9.4 The licensed software is downloaded from the downloading platform and you shall abide by stipulations of the download platform, system platform and terminal manufacture on application ways and restrictions of the licensed software. If the above mentioned third party confirms that you are in breach of the agreement and Eastern Kestone Eletrônico e Segurança LTDA and its supplier’s treatment is required, Eastern Kestone Eletrônico e Segurança LTDA may terminate your application license at the third party’s request.
9.5 When the application license terminates, you shall stop using the licensed software and destroy all copies.
9.6 You must bear all compensation responsibilities if Eastern Kestone Eletrônico e Segurança LTDA and other users suffer from losses caused by your breach of terms in the Agreement.
X. Governing Laws and Severability
10.1 Effectiveness, explanation, change, execution and dispute settlement of the Agreement are subject to laws of the People’s Republic of China. If no relevant laws and regulations are available, reference to general international business practices and (or) industrial practices shall be made.
10.2 Dispute arising from or in connection with the Agreement may be settled by you and Eastern Kestone Eletrônico e Segurança LTDA through friendly negotiation or submitted to People’s Court of Please enter your company address where the Agreement is signed for adjudication.
10.3 When any term of the Agreement is judged to be invalid by the People’s Court, it will not influence the effectiveness of other terms or any part thereof, and you and Eastern Kestone Eletrônico e Segurança LTDA shall perform the valid terms in good faith.
